CONSTRUCTION & BUSINESS LAW
Whelan Construction Law is a boutique law firm specializing in construction & business law. The complexity of construction projects – large or small – requires expert legal advice to prevent or resolve problems that arise before, during, and after construction. Our understanding of the construction industry allows us to prevent issues from arising, but when they do, we are experts in developing innovative solutions to practical problems clients face in all phases of their construction. We represent both plaintiffs and defendants, from public and private owners, developers, contractors, subcontractors, architects, engineers and suppliers in a broad range of disputes from simple matters such as recording liens to preparation and trial of complex construction and business disputes involving multiple parties and legal claims.
HOW WE CAN HELP
We represent clients in need of assistance with construction law matters and other types of legal issues arising out of business and commercial law. We provide support at all levels and phases of construction and business litigation – from early planning and development to dispute avoidance and resolution when things don’t go as planned.
When you are facing a construction dispute or litigation – whether large or small – it is essential to have experienced legal counsel handling your case. We help our clients confidently approach all phases of their construction projects and resolve disputes in a timely and cost-effective manner. We work to proactively avoid or resolve disputes, frequently using mediation and arbitration, and moving on to litigation only when it is necessary.
There is no such thing as a “typical” construction contract. The terms of construction contracts vary wildly and are unique to each individual project. The terms set forth in the construction contract can have significant consequences over the course of a project and the rights and obligations of the contracting parties. Well-written provisions in a construction contract can prevent legal issues from arising. At Whelan Construction Law, we help our clients avoid the pitfalls associated with poorly written contract documents.
Many aspects of construction are regulated by laws covering public, as well as private construction work. Wading through all the federal, state, and local legislation and regulatory requirements that impact construction projects can be overwhelming. We have the expertise and skill to guide our clients through the intricacies of government contracting, compliance with statutes and regulations, governmental investigations and administrative proceedings, and contractor licensing issues.
Construction is complex, multi-faceted, and unfortunately, replete with both financial and legal risk. At Whelan Construction Law, our goal is to limit risk and, when risk results in loss or potential loss, control the fallout as fully and immediately as possible. Litigation relating to disputes is always an option; however, it is not the first option, nor the first line of defense. The most effective approach is that of claim prevention.
At Whelan Construction Law, we know how it important it is to have legal counsel that understands your business’s particular needs, and we are committed to tailoring our legal strategies to meet your goals. We have worked with clients in a wide range of industries, bringing broad deal expertise, knowledge of commercial law, creativity and practical know-how to find innovative and efficient solutions for the business and commercial needs of our clients.
